The current terms cancel and replace all previous terms of service which are no longer usable against SiteW.
When the terms of service change, SiteW shall inform all its users.
These Terms of Use will be governed by and construed in accordance with the french laws, without giving
effect to its conflict of law provisions or your actual state or country of residence. Any claims, legal
proceeding or litigation will be brought solely in Aurillac, France,
and you consent to the jurisdiction of such courts.
The user acknowledges he read these terms and will respect them.
Despite of this, if the user website becomes unavailable, the user may ask for a compensation equal to the subscription amount calculated for the unavailability period. This compensation may only be reversed in credit (usable for any service provided by SiteW). This compensation cannot be claimed in the following cases:
Since the provided services are highly personalized, the retractation right is not applicable to SiteW services.
A subscription is subscribed for the period displayed in the cart.
A subscription may concern domain names, options and/or a package.
A user can upgrade anytime to a subscription which includes more services that he already has. This will lead to a renewal of the subscription with a new price and to a refund of the unconsumed paid days (the base takes into account any reduction the user may had).
The non-payment of a renewal leads to the disruption of the website the day of the subscription end-of-validity. The website is then destroyed 20 days after the subscription end-of-validity.
The user is warned when a renewal payment is required (by email and from the pages My websites and My cart). The non-payment of a renewal leads to an automatic subscription termination.
If the subscription initial payment was a credit card or Paypal payment, the next renewal will be automatically payed between about 1 month and 20 days before the end of the contract. The automatic renewal can be suspended anytime before its execution by going to My bills.
If the user had reductions when he subscribed, the subscription renewal will be charged at normal price.
The user is committed for the subscription paid period. Each operation of subscription creation or renewal updates this commitment. The user can ask for the subscription and website to be destroyed before the end of validity, which will not lead to a refund for the unconsumed and already paid period. By asking for the destruction of the websites and/or services, the user acknowledges that he will not ask for a refund of unconsumed and already payed days as of any prepaid service. At the exception of cases explicitly written in this page, no funds can be requested from SiteW.
If a payment was rejected due to user claim to his bank, fees may be added to renew a subscription.
The payment may only be done if the total amount of the cart (VAT, credits, and reductions included) is greater than the minimum amount stated in the cart.
We call domain name any website address ending by one of the sitew provided extensions (.org.uk, .net.nz, .co.nz, .co.uk, .name, .info, .net, .org, .biz, .com, .ws, .us, .ca, .cc, .eu, .be, .fr, .dk, .re, .ch, .de, .es, .li, .lu, .at, .cz, .me, .in, .pl) except sitew domains (.sitew.org.uk, .sitew.org, .sitew.com, .sitew.fr, .sitew.us, .sitew.es, .sitew.ca, .sitew.be, .sitew.ch, .sitew.de, .sitew.it, .sitew.eu, .sitew.in).
Domain names are booked at the extension registry or using a provider registered to the extension registry. No fee have to be claimed by the registry nor any provider. SiteW pays the required fees to book and renew the domains and keep them working during all the website subscription associated.
Each extension condition can be found at the extension registry (address available on demand).
The domain name is registered in the user name. The user is the owner of the domain name. In case of subscription termination, the domains can be transfered to the user's choice provider. To benefit of this feature, the request must be done 15 days before the expiration of the domain name and subject to transferability (see required conditions on the receiving provider).
Account and websites creation requires that the user gives a valid email address. Email validity is checked when the email address is added, by sending an email which requires a user action. Any account and websites which has no valid email address will be automatically destroyed 10 days after sign up. SiteW may destroy any website and associated account which has no valid email address. SiteW may destroy any website and associated account, if it is not updated for a period greater than 6 months. The user will be notified by email 15 days before the deletion of his website/account. SiteW may destroy any user uploaded file which is not used in its websites 30 days after their uploads.
