The current terms cancel and replace all previous terms of service which are no longer usable against SiteW. When the terms of service change, SiteW shall inform all its users.
Account and websites creation requires that the user gives a valid email address. Email validity is checked when the email address is added, by sending an email which requires a user action. Any account (and websites) which have no valid email address will be automatically destroyed 10 days after sign up. SiteW may destroy any website and associated account which has no valid email address. SiteW may destroy any website and associated account, if it is not updated for a period greater than 6 months. The user will be notified by email 15 days before the deletion of his website/account. SiteW may destroy any user uploaded file not used in any of their websites 30 days after their upload or last use.
If the user website becomes unavailable, the user can ask for a compensation equal to the subscription amount calculated for the unavailability period. This compensation may only be paid as a credit (available for any service provided by SiteW). This compensation cannot be claimed in the following cases:
In compliance with the law, for services that are highly personalized, such as and not limited to websites and domains the right of withdrawal does not apply.
A subscription is taken out for the duration chosen.
A subscription may concern domain names, options and/or a package.
Users can upgrade anytime to a subscription including more services. This will lead to a renewal of the subscription with a new price and to a refund of the remaining paid period (the base takes into account any discount the user was entitled to when he subscribed).
The user is warned when a renewal payment is required (by email and on the page My websites). The non-payment of a renewal leads to an automatic subscription termination.
If the initial subscription payment was made by credit card or paypal, the next renewal will be automatically paid between 20 days and about 1 month before the end of the contract. The automatic renewal can be stopped anytime before its execution by going to My bills.
Unless otherwise stated, if the user enjoyed a discount when he subscribed, the subscription renewal will be charged at normal price.
The non-payment of a renewal leads to the disruption of the website at the end of validity of the subscription. The website is then destroyed 20 days after the end of validity of the subscription.
The user is committed for the subscription paid period. Each operation of subscription creation or renewal renews the commitment. For website or options, the user can ask for the subscription to be destroyed before the end of validity, which will not lead to a refund for the unconsumed and already paid period. By asking for the destruction of the websites and/or services, the user acknowledges that he will not ask for a refund of the remaining paid period, nor of any prepaid service. With the exception of cases explicitly stated on this page, no refund shall be provided by SiteW.
If a payment was rejected due to the user complaining to his bank, fees may be added to renew a subscription.
The payment may only be done if the total amount of the cart (VAT, credits, and reductions included) is greater than the minimum payment amount stated in the cart.
We call domain name any website address ending with one of the sitew provided extensions (.net.nz, .com.mx, .org.au, .com.au, .org.uk, .net.au, .co.nz, .co.uk, .name, .info, .org, .biz, .net, .com, .dk, .cc, .ca, .ws, .eu, .be, .fr, .us, .yt, .re, .ch, .de, .es, .li, .lu, .at, .cz, .me, .in, .pl) except sitew domains (.sitew.org.uk, .sitew.org, .sitew.com, .sitew.fr, .sitew.ca, .sitew.us, .sitew.it, .sitew.de, .sitew.be, .sitew.ch, .sitew.re, .sitew.es, .sitew.eu, .sitew.in).
Domain names are booked at the extension registry or using a provider registered to the extension registry. No fees have to be claimed by the registry nor any provider. SiteW pays the required fees to book and renew the domains and keep them registered and configured during all the subscription period of the associated website.
Each extension condition can be found at the extension registry (address available on demand).
The domain name is registered in the user's name. The user is the owner of the domain name. On request, the domain can be unlinked from a website and configured or transferred to the user's provider of choice. Transfer requests must be done 15 days before the expiration of the domain name and is subject to transferability (see receiving provider conditions).
Depending on the registry contract, domain validity might be different from website validity.
Domain deletion service is not provided.
Failure to renew a domain (or linked website) in time may result in a restoration fee or the domain can become publicly available again and may not be available for re-registration.
